Regulation of the Prime Minister of 19 December 2007 on the value threshold of contracts and design contests which imposes an obligation of dispatching the notices to the Office for Official Publications of the European Communities  (Journal of Law No. 241, item 1762)

Pursuant to Article 11 (8) of the Act of 29 January 2004 – Public Procurement Law (Journal of Law of 2007 No. 223, item 1655), it is decreed as follows:

§1. Contract notices shall be dispatched to the Office for Official Publications of the European Communities, if the value of contracts:

1) awarded by awarding entity from the public finance sector, in the meaning of legal provisions on public finances, excluding state universities and colleges, research and development entities, state cultural institutions and self-government sub-sector, as well as awarded by awarding entity being other state organisational units without legal personality, is equal to or exceeds PLN equivalent of:
a) EUR 133 000 – for supplies or services,
b) EUR 5 150 000 – for works;

2) awarded by awarding entities other than listed in point 1, excluding contracts referred to in point 3, is equal to or exceeds PLN equivalent of:
a) EUR 206 000 – for supplies or services,
b) EUR 5 150 000 – for works;

3) In case of sectoral contracts, is equal to or exceeds PLN equivalent of:
a) EUR 412 000 – for supplies or services,
b) EUR 5 150 000 – for works.

§2. Design contest notices shall be dispatched to the Office for Official Publications of the European Communities, if the value of design contests:

1) held by awarding entity from the public finance sector, within the meaning of regulations on public finances, excluding state universities and colleges, research and development entities, state cultural institutions and self-government sub-sector, as well as held by awarding entity being other state organisational units without legal personality, is equal to or exceeds the PLN equivalent of EUR 133 000;

2) held by awarding entities other than listed in point 1 and 3, is equal to or exceeds the PLN equivalent of EUR 206 000;

3) held by awarding entities awarding sectoral contracts, is equal to or exceeds  the PLN equivalent of EUR 412 000.

§3. To contract award procedures commenced prior to the entry into force of this Regulation, the hitherto provisions shall apply.

§4. The Regulation of the Prime Minister of 19 May 2006 on the value threshold of contracts and design contests which imposes an obligation of dispatching the notices to the Office for Official Publications of the European Communities (Journal of Law No. 87, item 604 and of 2007 No. 36, item 228) shall be repealed.

§ 5. The Regulation shall enter into force on 1 January 2008.
