SECRETARIAT OF THE PRESIDENT
The Secretariat of the PPO President provides organisational and
office services for the PPO management (President, Vice Presidents and
Director General). It arranges, together with the PPO spokesman,
contacts with mass media and external institutions. The Secretariat
also provides organisational services for the Public Procurement
Council (a consultative and advisory body on public procurement) and is
responsible for maintaining records and documents related to the works
of the Council.
Legal Department provides both internal and external legal services
for the Public Procurement Office. The tasks of the department are
carried out by its four units:
- Legislation
- Legal Opinions
- Administrative Decisions and Court Cases
- European Law.
The activities of the Legislation Unit include in particular:
preparation of draft legal acts in the field of public procurement, as
well as participation in the legislative process with regard to legal
acts prepared by other governmental institutions and related to public
procurement issues.
The activities of the Legal Opinions Unit focus in particular on:
explanation and interpretation of provisions provided by the Public
Procurement Law, dissemination of legal interpretations, preparation of
general contract terms, standard contract patterns and instructions
concerning contract award procedures.
The activities of the Administrative Decisions Unit are: preparation of
administrative decisions to be issued by the President of the PPO
pursuant to the Public Procurement Law and analysis of data concerning
these decisions.
The activities of the European Law Unit cover among other: monitoring
the compliance of the Polish public procurement law with the
requirements of the EU directives, preparation of Poland’s positions
with regard to ECJ cases concerning public procurement, analyses of
changes and developments in international law and agreements in the
field of public procurement.
The Control Department carries out the tasks related to control
powers of the President of the PPO provided for in the Public
Procurement Law and organizes the cooperation of the PPO with other
control institutions (such as Supreme Chamber of Control or regional
audit chambers).
In particular the Control Department is responsible for carrying out
ex-ante and ex-post control on particular contract award procedures on
the basis of information and documents obtained from awarding entities
and other sources.
The Control Department is divided into four units:
- Ex-ante Control of Contracts for Supplies and Services
- Ex-ante Control of Contracts for Works
- Ex-ante Control of Contracts in the Utilities
- Ex-post Control
- Ad hoc Control
EDUCATION AND INTERNATIONAL COOPERATION DEPARTMENT
The Education and International Cooperation Department is
responsible for the overall scope of activities connected with
preparation of training events, dissemination of training materials and
cooperation with international organizations and foreign authorities
acting in the field of public procurement.
The Education and International Cooperation Department disseminates
information on the public procurement principles and provisions among
procuring entities and companies acting on the public procurement
market, organises seminars and training events for arbiters, elaborates
publications and guides on the application of public procurement
provisions, as well as the website service of the PPO. It also
participates in the implementation of support programmes which aid in
the development of the public procurement system in Poland.
The Education and International Cooperation Department is also
responsible for organization of international contacts of the PPO and
its cooperation with relevant authorities in other countries and
international organizations dealing with public procurement issues. The
Department gathers and disseminates information about foreign and
international public procurement provisions and procedures.
E-PROCUREMENT AND SYSTEM ANALYSES DEPARTMENT
E- Procurement and System Analyses Department coordinates the
activities concerning the e-procurement, monitors the functioning of
the public procurement system as well as draws up and gathers the
analytical materials on the national and Common public procurement
market.
E- Procurement and System Analyses Department carries out the tasks of
the Public Procurement Office concerning the publication of notices and
information in the Public Procurement Bulletin.
The Appeals Department carries out tasks related to appeal
proceedings under the Act on Public Procurement and provides services
for the arbitration panels.
The area of its activities covers among other: maintenance of the
register of arbiters and the archives of appeal cases, preparation of
drafts of decisions (to be issued by the President) about the entrance
into and removal from the arbiters' register.
ORGANISATIONAL AND FINANCIAL BUREAU
The Organisational and Financial Bureau provides services with
regard to accounting, administrative and organisational aspects of
activities carried out by the PPO. The tasks of this department include
in particular: elaboration of draft budgets of the PPO, investment
plans and schedules of expenses, preparation of reports and information
on the budget execution.
The Organisational and Financial Bureau receives and dispatches
external correspondence, gathers and stores official documents and
manages the archives of the PPO.
This unit administers also the internal computer network as well as the
publicly available website of the PPO.
